Concert Terms and Conditions 

         These Concert Terms and Conditions (“T&Cs”) apply to Setlist LLC’s (the “Organizer”) event Island Feels in the Hills (the “Concert”), the Organizer’s sale of an admission ticket to the Concert (the “Ticket”) to the Customer, and the Customer’s purchase of the Ticket.  These T&Cs include important information regarding restrictions, rights, consents, and waivers.  Please be sure to read these T&Cs before purchasing a Ticket.  Failure to comply with these T&Cs will result in refusal of entry, removal from the Concert, or other measures deemed reasonable and necessary in the Organizer’s sole discretion and will not entitle the Customer to a refund.

  1. Acceptance of Concert Terms and Conditions.  The Customer’s purchase of a Ticket will be deemed the Customer’s acceptance of the Concert Terms and Conditions.  Further conduct such as entering the Concert venue will be deemed further evidence of the Customer’s acceptance of these T&CS.   

  2. The Concert.  These T&Cs apply to the Organizer’s event Island Feels in the Hills to be held on January 18, 2025 at the LeoPalace Resort Guam (the “Concert Grounds”) featuring The Green.  Entry doors will open at 4:00p.m.  The event will conclude at 11:30p.m.  

  3. The Organizer’s Right to Amend Concert Details.  The Organizer may, in its reasonable discretion, amend Concert details, including without limitation, the venue, entry time, and end time.  The Organizer will only make such changes if deemed necessary for the safety of all parties.  In the event of a change, the Organizer will provide written notice via email to all Customers as soon as practical.    

  4. Safety.  Safety is of the utmost importance for the Concert.  The Organizer may prohibit certain items or conduct from the Concert Grounds.  The Organizer may, in its sole discretion, refuse entry of a Customer or remove a Customer from the Concert Grounds if the Organizer determines that the Customer (i) attempted to bring or brought prohibited items into the Concert Grounds, (ii) attempted to carry out or carried out any prohibited activity, or (iii) threatened, attempted to compromise, or compromised the safety of others.  If a Customer is refused entry or removed from the Concert Grounds, no refund of the Ticket will be granted.  

  5. Prohibited Items.  The following items are prohibited from the Concert Grounds: weapons (or items that may be used as weapons), guns, grenades, knives (including pocket knives), blades, brass knuckles, tasers, laser pointers, sparklers, fireworks, personal alcohol, crystal-methamphetamine (or any derivative or similar substance) or fentanyl or fentanyl-containing substances.  This list is not exhaustive and may be updated by the Organizer at any time.  This list notwithstanding, the Organizer may at any time and in its sole discretion prohibit any other items that may compromise the safety of others.  Any Customer found with a prohibited item at the entry gate or security check will be asked to store the prohibited item outside the Concert Grounds and will not be permitted entry until such prohibited item is stored.  The attempt to bring in a prohibited item is a violation of these T&Cs and a refund will not be available to the Customer.  Any Customer found with a prohibited item within the Concert Grounds will be removed from the Concert Grounds and may only be readmitted with the consent of the Organizer, which may be withheld in the Organizer’s sole discretion. Bringing a prohibited item into the Concert Grounds is a violation of these T&Cs and a refund will not be available to the Customer. 

  6. Prohibited Conduct.  The following conduct is prohibited from around or within the Concert Grounds: fighting or enticing a fight (“calling someone out”), rioting, mosh-pitting, pushing, punching, slapping, unwanted touching of others, treating others discourteously or disrespectfully, disobeying instructions from the Organizer or its Security Team, entering marked off areas, stealing, or attempting to providing or providing alcohol or other prohibited substances to a minor.  For the avoidance of any doubt, any conduct that would violate the laws of Guam is prohibited conduct.  This list is not exhaustive and may be updated by the Organizer at any time.  Any Customer that attempts to carry out or carries out any prohibited conduct may be refused entry into the Concert Grounds or removed from the Concert Grounds.  As an attempt to carry out or carrying out prohibited conduct is a violation of these T&Cs, a refund will not be available to any Customer who is refused entry or removed for such violation. 

  7. Consent to Removal; Waiver of Claims.  Any Customer that must be removed from the Concert Grounds as a result of a violation of these T&Cs will first be kindly asked to leave.  Should the Customer refuse to leave, the Security Team will escort the Customer out of the Concert Grounds.  By purchasing a Ticket, the Customer consents to being removed by the Security Team in the event removal is required as provided herein.  The Customer acknowledges that reasonable force may be necessary to carry out the removal in the event the Customer will not comply with the request to leave the Concert Grounds.  The Customer consents to such use of reasonable force and waives any claim for injury or other damages that may arise out of or in connection with such removal.  

  8. Refunds.  A refund will be available only upon the occurrence of one of the following and provided the requirements set herein are met: (i) The Green does not play at the Concert; (ii) the Concert is cancelled by government order and not rescheduled within a reasonable time (each a “Refund Event”).  Should either of the above occur, a refund will be granted upon the written request of the Customer less any ticketing or processing fees.  The written request must be made within seven (7) days of the occurrence of a Refund Event.  A refund will not be granted for any reason other than a Refund Event. 

  9. No Authorized Third-Party Ticket Agent.  The Organizer is the only authorized Ticket seller for the Concert.  The Organizer cannot and will not provide any remedy or recourse for tickets purchased from a third-party source that are determined invalid, previously redeemed or in use, fake, compromised, or defective.  Note:  This Concert will utilize Ticket-specific QR codes.  A nefarious party may purchase a single ticket, print copies, and sell them to others.  Once a QR code is scanned, the Ticket will be redeemed and locked, and any one else with the same QR code will not be permitted entry. 

  10. Waiver of Liability.  The Customer understands, acknowledges, and agrees that the Concert is an outdoor event with many other people in attendance.  The Organizer will use best efforts to provide a safe environment for all.  Nonetheless, to the greatest extent permitted by law, the Customer hereby waives any claim for injury or any other damages it may have or incur that arises out of or in connection with the Customer’s participation at the Concert with the exception of the Organizer’s willful misconduct or gross negligence.  Through this waiver, the Customer releases the Organizer, LeoPalce Resort Guam, and The Green Band LLC from any and all liability in connection with the Customer’s participation at the Concert to the fullest extent permitted by law. 

  11. Indemnity.  Many others will participate at the Concert and every person has the responsibility to maintain a safe environment and not create any safety risks for others.  Thus, to the fullest extent permitted by law, the Customer agrees to indemnify, defend, and hold harmless the Organizer, LeoPalace Resort Guam, and The Green Band LLC from any and all claims for injury, expenses, or any other damages that arise out of or in connection with the Customer’s conduct, misconduct, omissions, or negligence. 

  12. Modification.  These T&Cs may be modified at any time by the Organizer.  These T&Cs and any modifications thereto will be made available on www.clutch.com/events/termsandconditions.   Any modifications will be effective and deemed received by the Customer at the time it is posted on the website. 

  13. Contact Information.  The Customer is responsible for providing the Organizer with correct and current contact information.  The Customer represents that the name, email address, and phone number provided on the Ticket platform are correct and current.  In the event contact information changes, the Customer is responsible for providing such information to the Organizer at events@clutch-music.com.

  14. Good Vibes.  This Concert is for the benefit and enjoyment of our beautiful island and people.  It is a celebration.  We seek to bring and spread good vibes.  Come join us.  Please respect yourself, others, the Concert, and the venue.  It’s Clutch Time.
